The Pearl Escape

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT. BY SIGNING BELOW, YOU WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. 1. Acknowledgment of Participation I, the undersigned passenger (“Participant”), understand and voluntarily agree to participate in a guided wine tour provided by Breezy Wine Tours Inc. (the “Company”). I acknowledge that this may include transportation in a motor vehicle, visits to wineries or similar venues, walking, and consumption of alcohol at third-party establishments. I understand that participation is entirely voluntary and at my own risk. 2. Assumption of Risk I acknowledge and accept that participation involves inherent and foreseeable risks, including but not limited to: • Transportation in motor vehicles on public and private roads; • Interaction with other participants and members of the public; • Consumption of alcohol and its associated health or behavioral risks; • Uneven terrain, stairs, wet or slippery surfaces, or environmental hazards; • Exposure to changing weather conditions. I accept full responsibility for all such risks and waive any claim against the Company. 3. Alcohol Consumption & Compliance with Law I confirm that I am at least 19 years of age. I understand: • The Company does not provide or serve alcohol; • Open alcohol is not permitted in the vehicle; • I am responsible for my own consumption; • The Company may terminate my participation without refund for misconduct or intoxication. 4. Conduct & Responsibility for Damages I agree to behave respectfully and lawfully. I understand I may be charged a cleaning/damage fee starting at $500 for any damage or mess caused. 5. Medical Conditions & Emergencies I confirm I am physically able to participate. In an emergency, I authorize the Company to seek treatment on my behalf and agree to cover any resulting costs. 6. Photography & Promotional Use I grant permission for any media taken during the tour to be used by Breezy Wine Tours for marketing purposes. (Opt-out available upon request.) 7. Release & Waiver of Liability To the fullest extent permitted by Ontario law, I release Breezy Wine Tours Inc. and its affiliates from any liability arising from my participation. 8. Indemnification I agree to indemnify and hold harmless the Company against any claims arising from my actions. 9. Governing Law & Jurisdiction This agreement shall be governed by the laws of Ontario. 10. Voluntary Execution I confirm I’ve read and understood this agreement and am signing voluntarily.
